Terms of Service

These Terms of Service ("Terms") govern access to and use of Flowsophy and related services (the "Service"), which is operated by the developer of Flowsophy ("Flowsophy," "we," or "us"). By creating an account or using the Service, the user agrees to be bound by these Terms. If the user does not agree, they must not use the Service. For questions, contact us at hi@flowsophyapp.com.

Eligibility

The user must be at least 13 years old, or older where the law of the user's country sets a higher age of digital consent (up to 16 in parts of the European Union). By using the Service, the user represents that they meet this requirement and that the information they provide is accurate. The user is responsible for maintaining the security of their account and for all activity that occurs under it.

The Service

Flowsophy generates AI-assisted Flowmaps from a topic, video, or document that the user provides, and allows the user to save, annotate, and optionally share those Flowmaps. The Service is provided for general educational and informational purposes only and does not constitute professional advice.

Sparks and payments

Generating Flowmaps consumes Sparks. New accounts receive a limited number of Sparks, and additional Sparks may be purchased through our third-party payment provider. Applicable prices are displayed within the Service before purchase.

Sparks represent a limited, revocable license to use generation features. They have no monetary value, are non-transferable, and are not redeemable for cash. Because Sparks and the outputs they produce are digital and made available immediately, purchases are final once Sparks are used, except that Sparks are refunded automatically where a generation fails or is cancelled. Purchases made through a mobile application store are subject to that store's billing and refund policies. Nothing in these Terms limits any non-waivable rights the user may have under applicable consumer law.

Acceptable use

The user agrees not to use the Service to violate any applicable law, to harass, harm, impersonate, or infringe the rights of others, to upload or share unlawful, hateful, or abusive content, to interfere with, disrupt, scrape, or reverse engineer the Service, or to circumvent Spark costs, usage limits, or other technical controls. Any content the user creates, including profile information, notes, and shared Flowmaps, is subject to these restrictions.

User content

The user retains ownership of the content they create through the Service, such as the topics they enter, their notes, and their noteboards. The user grants us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the Service, and, for content the user chooses to share, to make it available to others as the user directs. The user is solely responsible for the content they create and share and represents that they hold the rights necessary to do so. We may remove content or restrict access that violates these Terms.

AI-generated content

Outputs generated through the Service are produced by artificial intelligence and may be inaccurate, incomplete, or outdated. They are intended as a learning aid and do not constitute professional, legal, medical, financial, or other advice. The user is responsible for independently verifying any information before relying on it.

Intellectual property

The Service, including its name, design, and software, is owned by Flowsophy or its licensors and is protected by applicable intellectual property laws. These Terms grant the user no rights in our trademarks or software other than the right to use the Service as permitted.

Suspension and termination

The user may stop using the Service and delete their account at any time within the Service or through our account deletion page. We may suspend or terminate access if the user violates these Terms or if their use poses a risk to the Service or to others. Following termination, data is handled as described in our Privacy Policy.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free or that any output will be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to the user.

Limitation of liability

To the fullest extent permitted by law, Flowsophy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to use of the Service. Our total liability for any claim arising from or relating to the Service will not exceed the greater of the total amount the user paid us in the twelve months before the claim or one hundred United States dollars. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Changes to these terms

We may modify these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

Schools

Flowsophy for schools is offered to schools and teachers by invitation through schools.flowsophyapp.com. A teacher who creates student accounts represents that their school has authorized them to do so and has obtained any consent its law requires. Student accounts hold no Sparks and cannot make purchases. The teacher can read what a student writes on an assigned Flowmap, and the teacher decides whether Wikipedia and the Guide are available to the class. A school may ask us to delete its students' data at any time.

Mobile applications

If the user obtains the app through the Apple App Store or Google Play, these Terms are an agreement between the user and Flowsophy only, and not with Apple or Google. Apple and Google are not responsible for the app or its content and have no obligation to provide maintenance or support for it. To the extent permitted by law, Apple and Google are not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection law, and, in the event of a third-party claim that the app infringes intellectual property rights, Flowsophy, not Apple or Google, is responsible for the investigation, defense, settlement, and discharge of such claim. The user must comply with the applicable store's terms of service when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms as they apply to the iOS app, and upon the user's acceptance of these Terms, Apple has the right to enforce them against the user as a third-party beneficiary. Purchases of digital items within a mobile app are made through the store's in-app purchase system and are subject to the store's billing and refund policies.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The state and federal courts located in California will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service, except where applicable law grants the user the right to bring proceedings in their place of residence.
